The Ultimate Caribbean Getaway Contest sponsored by Island Federal Credit Union is open to all legal United States residents who, as of the entry date, are 18 years of age or over living in New York. The Contest is void in all other jurisdictions and where prohibited or restricted by law. Employees of Newsday LLC (“Newsday”), its parents, affiliates, subsidiaries, advertising sponsors (including without limitation Island Federal Credit Union) and promotional agencies, and any other persons or entities directly associated with the Contest (collectively, the "Contest Entities"), and the immediate family members of each are not eligible.
2. CONTEST ENTRY PERIOD
The "Contest Entry Period" begins at 11:00 A.M. Eastern Time on March 19, 2012 and ends at 3:00 P.M. Eastern Time on April 15, 2012.
3. HOW TO ENTER
a. To enter, go to newsday.com/contests during the Contest Entry Period and follow the links and instructions to submit your entry information, including your Photo (as defined and described in Section 3(b) below). Each entrant (sometimes referred to herein as a "contestant") must completely fill out the online entry form, and submit the Photo in accordance with the on-screen instructions. All entries must be submitted online. Mailed or hard copy entries will not be accepted. All entries (including Photo submissions) must be received by the end of the Contest Entry Period. Failure to submit all required information and submissions in the manner required in these Official Rules may result in disqualification. LIMIT: One (1) entry/photo per person depicting favorite vacation spot in the Contest. Duplicate entries risk disqualification.
b. Each entrant is required to submit an original photo (the “Photo”) and may submit no more than one Photo. Each Photo must be in good taste and must depict a vacation spot that the contestant has visited. Newsday reserves the right to disqualify any Photo for any reason, including but not limited to the entrant's failure to comply with the requirements in this paragraph. BY SUBMITTING AN ENTRY, ENTRANTS ACKNOWLEDGE THAT THEIR ENTRIES MAY BE POSTED ON WWW.NEWSDAY.COM OR ANY OTHER WEBSITE(S) AUTHORIZED BY NEWSDAY FOR THE CONTEST (COLLECTIVELY "THE WEBSITE"), AT NEWSDAY'S DISCRETION AND CAN BE VIEWED BY OTHER WEBSITE USERS. Submission of an entry grants Newsday, its parent and affiliate companies, its advertising sponsors and promotional agencies, and their respective agents an unlimited, worldwide, perpetual license and right to publish, use, modify, edit, adapt, copy, exploit, and publicly display the entry in any way, in any and all media, without limitation, and without consideration or acknowledgment to the entrant.
c. All submissions in the Contest (and all components of such submissions) by an entrant must be the entrant's own. By entering the Contest and submitting a Photo, each entrant represents (i) that the entrant is the copyright owner of the Photo or has written permission from the copyright owner to enter the Photo in this Contest and to grant all rights necessary to use the Photo in the Contest, (ii) that the entrant has granted an irrevocable license to publish, republish, distribute and copy the edited Photo an unlimited number of times in any print, electronic or other medium, and (iii) that the entrant has obtained from anyone identified or depicted in the Photo (or the parent or guardian of any child identified or depicted) all permission necessary to grant the foregoing license. Modifying, enhancing or altering a third party's preexisting work does not qualify as an entrant's original creation. Each submission may not, and by entering the Contest and submitting a Photo, each entrant represents that the entrant's submission will not, be offensive or inappropriate, defame or invade publicity rights or privacy of any person, living or deceased, or entity, or otherwise infringe upon or violate any person's or entity's personal, intellectual property or property rights or any other third party rights. Newsday reserves the right, in its sole discretion, to disqualify any entry for any reason, including any entry Newsday deems, in whole or in part, to be offensive or inappropriate. By submitting your entry, you agree that your entry conforms to these Official Rules. Any submission that does not comply with any aspect of these Official Rules may be rejected by Newsday and the entrant disqualified. By submitting your entry, you agree to assume all liability for and indemnify and hold harmless Newsday, the Contest Entities, and their parents, affiliates, employees, contractors and agents from any and all claims arising out of the publication or use of your entry, including without limitation any failure of your entry to comply with these Official Rules or any representations being made by you herein.
d. No responsibility is assumed for late, lost, damaged, incomplete, illegible, or misdirected applications. No responsibility is assumed for technical, hardware, software or other online entry malfunctions of any kind or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the sender, or by any of the equipment or programming associated with or utilized in the contest which may limit the ability to participate, or by any human error which may occur in the processing of the application for the Contest. If for any reason, (including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Newsday, which corrupts or affects the administration, security, fairness, integrity, or proper conduct of the contest), the Contest is not capable of being conducted as described in these Official Rules, Newsday shall have the right, at its sole discretion, to cancel, terminate, modify or suspend the Contest.
4. WINNER SELECTION/VOTING
Eligible entries accepted by Newsday in accordance with these Official Rules will be posted on the Website. Beginning at 3:00 p.m. Eastern Time on April 15, 2012 until 3:00 p.m. Eastern Time on April 29, 2012, online visitors to the newsday.com/contests website will be able to vote for the best picture. The top 10 Photos with the most votes will advance to the finals, where a panel of judges, which may include representatives from advertising sponsors of the Contest, will choose one (1) grand prize winner based on the overall appeal of the Photo and the vacation spot featured in it. The remaining nine contestants will be invited to attend a function during which seven (7) runner-ups will be chosen by random for a chance to be one (1) second place prize winner, one (1) third place prize winner, two (2) fourth place prize winners, or two (2) fifth place prize winners. In the event of a tie in the vote for inclusion in the top 10 Photos, the entry submitted earliest will advance. The decisions of the judges and Newsday with respect to the selection of the winners and in regard to all matters relating to this Contest shall be final. Automated voting of any kind is not allowed. Detection of said automated voting will lead to votes being voided.
The grand prize winner will receive a round trip for two (2) people to Nassau Bahamas. Approximate retail value of grand prize is $3,700. One (1) second place prize winner will receive a Nikon Coolpix S100 16 megapixel camera. Approximate retail value of second place prize is $299. Two (2) Third Prize winners will each receive a $100 VISA gift card and six (6) Fourth Prize winners will each receive a $50 VISA gift card. All prizes are non-transferable, non-negotiable and not redeemable for cash, credit or merchandise. The Contest Entities are not responsible for prize delivery delays for any reason. No substitutions of prizes allowed except by Newsday, which reserves the right to substitute a prize of equal or greater value. Any difference between the stated value and the actual value of the prize will not be awarded to the winner. Prizes do not include any travel expenses, insurances of any kind, personal expenses, gratuities, incidental charges or any other costs not specifically described in these Official Rules as part of the prize and will be the responsibility of the winners. Prize may not be sold or transferred to a third party. No warranty or guarantee will be given by Sponsor with respect to any prize.
Grand prize is a round trip for two (2) from JFK, New York to Nassau, Bahamas, for a five night all inclusive stay at Sandals Royal Bahamian Resort. Travel is on a major airline such as American Airlines or Jet Blue, based on availability. Package includes dining, entertainment, premium drinks, some water sports and round trip airport transfer in Nassau and a Pirates of Nassau Historical Tour.
Grand prize should be redeemed no later than December 15, 2012. Additional travelers, upgrades, non included meals, activities and tours are the sole responsibility of the winner. Reservation of resort, airline and tour are subject to availability. Blackout dates may apply. (Blackout dates include but not limited to weeks of all major travel holidays including New Years, President’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving and Christmas)
6. DRAWING AND NOTIFICATION
The grand prize winner will be selected by the Sponsor, from among the top ten finalists chosen on or around May 8, 2012. The remaining nine contestants will be invited to attend a function at Island Federal Credit Union located at 120 Motor Parkway, Hauppauge, NY 11788 on May 12, 2012, during which seven (7) runner-ups will be chosen by random. Odds of winning depend on the number of eligible entries received. Prize winners will need to sign release forms for the prize. If winners cannot be reached by the e-mail address provided on the entry, or if he/she is found to be ineligible, or if he/she cannot or does not otherwise comply with these Official Rules, or if the winner is unable to use the prize, such winner will forfeit his/her prize and Sponsor will have no further obligation to such winner, and the next eligible entry chosen randomly from among the remaining entries received will be awarded the prize. All entries become Sponsor's property and will not be returned. All decisions regarding interpretation of these Official Rules and administration of the Contest shall be made by Sponsor whose decisions are final and binding.
7. GENERAL CONDITIONS
All Federal, state and local laws and regulations are applicable. All taxes (including, but not limited to, income taxes) and the determination that such tax liability exists are the sole responsibility of winners. Potential prize winners may be required to execute an Affidavit of Eligibility, a Liability Release, and a Publicity Release ("Affidavit/Release") prior to distribution of prize. Non-compliance may result in disqualification and an alternate winner may be chosen. Return of prize, prize notification, or Affidavit/Release as undeliverable will result in disqualification and an alternate winner may be selected. Entry and/or acceptance of prize constitutes permission for the Contest Entities and their licensees and affiliates to use the winner's name, address (city and state), voice, biographical information, testimonial and/or likeness and image for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, including without limitation on-line. All entrants agree to comply with these Official Rules. Any person attempting to defraud or in any way tamper with this Contest and any person who does not comply with these Official Rules will be disqualified. Sponsor at its sole discretion reserves the right to cancel or modify the Contest, without liability. Void where prohibited, restricted or taxed by law.
By entering, entrants agree to release the Contest Entities from any and all losses or injuries of any kind arising out of their acceptance/possession and/or use/misuse of the prize, their participation in the Contest, or any technical malfunctions of the telephone network and/or transmission line, computer on-line system, computer dating mechanism, computer equipment, hardware, software, or any combination thereof, or any entries that are late (including delayed data transmissions), tampered with, garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, mechanically duplicated, illegible or otherwise not in compliance with these Official Rules. Entrants also agree that the Contest Entities are not responsible or liable for any injury or damage to an entrant or third person's computer system related to or resulting from Contest and its prizes. The Contest Entities are not liable for damage to a user's computer system in any way due to an entrant's participation in the Contest or downloading any information in connection with the Contest, including without limitation any server failure, lost, delayed or corrupted data or other malfunction.
If for any reason, the Internet-related portion of this Contest is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause which corrupts or threatens the administration, security or integrity of the Contest, Sponsor reserves the right, in its sole discretion, to terminate or suspend the Contest or any portion of the Contest. Any attempt to damage or undermine the fair and legitimate operation of this Contest will result in disqualification from the Contest.
10. DISPUTES/CHOICE OF LAW
EACH ENTRANT AGREES THAT THIS CONTEST SHALL BE GOVERNED BY THE LAWS OF THE STATE OF NEW YORK AND: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS CONTEST OR ANY PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY STATE OR FEDERAL COURTS SITUATED IN NEW YORK, (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, BUT IN NO EVENT ATTORNEYS' FEES, (C) NO PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES, MAY BE AWARDED, AND (D) ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM SPECIAL DAMAGES AND ALL RIGHTS TO HAVE SUCH DAMAGES MULTIPLIED OR INCREASED.
